Change to Guidelines for Fences

October 16, 2014

The architectural guidelines have been revised to allow for 8 foot fences, when being used for RV screening, and with proper ECIA approval. You may view the revised guidelines here.

 
New Management for ECIA

October 17, 2014

Following lengthy deliberations, the ECIA Board of Directors has decided to enter into negotiations with a management company, HOAMCO, to provide administrative services for the association.  After a brief fact-finding period, the board will meet with HOAMCO leadership to design a contract that will define the company’s role and responsibilities in the community.

Solar Array Litigation

October 4, 2014 - ECIA member Claudia Daigle, acting on her own behalf, has filed a civil suit in New Mexico District Court alleging that the association is in violation of its own covenants by allowing the construction of ground-based solar arrays.  The ECIA Board of Directors finds no merit to the arguments in the suit and will be filing an appropriate response with the court.  The board asserts that the association's extensive guidelines concerning photovoltaic arrays are in complete compliance with its own governing documents as well as all applicable local, state and federal law.

 
Updates on Litigation

 In legal developments, the New Mexico Court of Appeals has placed the poultry litigation, ECIA v. Billings et al., on its General Calendar for review.  A three-judge panel will look at the legal issues involved in the District Court decision by Judge Mark A. Macaron, which found that the ECIA covenants did not allow the keeping of hens.  Consideration of the case by the Court of Appeals is not likely to occur until later this winter, with a decision expected some months after that.
