Architectural Committee Meeting Minutes of May 28, 2019 DRAFT 1

TIME AND PLACE:
The bi-monthly meeting of the ECIA Architecture Committee was held on Tuesday, May 28th 2019 at 7 PM at the Community Center.

CALL TO ORDER: The meeting was called to order at 7:01 PM.

DESIGNATION OF QUORUM:
Attending the meeting were members: Chair, Katherine Mortimer, Gary Moran, Casey Cronin, Steve Taratula, Larry Ward, Board Liaison, Bernardo Monserrat, and Staff Representative, Mark Young. A quorum was established for this meeting.

Announcements:
1. Mark Young announced that the meeting was being recorded.
RESIDENTS:
There were 5 residents attending the meeting and one guest.

 NEW BUSINESS:

 1. UBL#1-23-21, Stewart Allison, 1 Encantado Place, with plans for a Ground based solar array. These revised plans moved the array to the SE side of the lot and screened it with fences, as per the request of neighbors. Due to their being a question as to whether the new proposed screening fence was outside of the 20 foot side setback, the applicant is going to go back and measure it and verity that there are no encroachment issues. If there are no issues the Committee will approve of the plans with the stipulation that the project is staked out and the ECIA is called before construction begins, so that the ECIA can verify that the setback is not being encroached upon. Additionally, the closest neighbors shall then be notified of this new array plans and location. Should any neighbors be concerned about this new location, the ECIA will require that the Resident come back before the Committee for re-review of the plans. Should the resident find that there is 3 feet or less of encroachment into the 20 foot side setback the committee is recommending approval of such a variance to the ECIA Board, but also the same stipulations will apply to the variance request, as stated above, and any concerned neighbors will be notified to come to the Board working session to express their concerns.

2. UBL # 1-17-17. Jenn and Jerry Anderson, 5 Birla Court, with plans for a new home of Norther NM Style. Due to the fact that the applicants have not closed on the home, the ECIA cannot provide any approval at this time. Additionally, due to the fact that the home plans do not include the required metal roof and a portal across the home, the architectural design could also not be approved. The Committee advised the resident to do back to their builder to see what changes he could make to make the home a style that matches the requirements of the Norther New Mexican homes, as detailed in the Eldorado Building Guidelines.

 

3. UBL# 3-13-17, Gregory and Linda Gaertner, 6 Cuesta Lane, with plans for a Metal Pergola. The applicants did bring in a sample of the wood like metal product and since it really looked like wood the ECIA approved of these plans with no stipulations.

 

4. UBL#2-22-22, Robert Ayers, 22 Esquila Road, with plans for screening fences and two variance requests for fences, with two of the fence panels already being constructed and without ECIA approval. The Committee could not approve of these plans due the fact that the site plans submitted were not accurate and actual surveys and the resident has to come back to the Committee with an accurate site plan showing the exact amount of encroachment of these fences. Gary Moran made a motion to table these plans until we received an accurate site plan and this was seconded by Steve Taratula and the motion passed unanimously.

 

Other Business:

1. The committee further discussed the issue of the accessory dwelling structures task force and Katherine stated that she agreed to chair the task force and asked for other interested members. Nina Harrison and Gary Moran agreed to serve on this committee. Mark Young agreed to the check with Board President, David McDonald regarding copying the Architectural Committee on the legal opinion by John Hays on the Accessory Dwelling units.
2. Casey Cronin made a motion to recommend approve of Committee member candidate, Mark Hiatt to the Architectural Committee as he had attend the requisite 2 meetings and would be an asset the committee. This motion was seconded by Gary Moran and passed unanimously.

NEW BUSINESS:

 

1. UBL#1-01-13, Kevin McCue, 65 Encantado Loop, with plans for a low profile Roof mount solar PV system as well as a small accessory structure. With almost no visibility of the panels, and the shed being well screened and painted to match the house color, these plans were approved with no stipulations.

2. UBL # 3-02-25, Erin Cone, 6 Eldorado Way, with plans for a very low profile and ballasted roof Mount Solar PV system. With almost no visibility of the panels, these plans were approved with no stipulations.

 

3. UBL# 2-18-18, Gary Stoller, 1 Baya Court, with plans for a low profile and ballasted roof Mount Solar PV system. With almost no visibility of the panels, these plans were approved with no stipulations.

 

4. UBL#1-60-30, Terrance Banen, 3 Antigua Road, with plans for a wood Dog ear enclosure fence. These plans were approved with the following stipulations:
a. Stringers shall be on the inside of the fence.

 

5. UBL # 2-24-09, Claudia Ahlstrom, 20 Reno Place, with plans for a new portal with a roof to match the existing portal and with parapets. These plans were approved with no stipulations.

7. UBL# UBL# 1-17-10, James Wilson, 11 Camerada Road, with plans for a new court yard wall at 42inches tall and to match the color of the home. Gates of wood. At the meeting the new owner asked to increase the size of the fenced enclosure to 3800 sq. ft., These plans were approved with the following stipulations:
a. Color of stucco to match home.

8. UBL#1-51-04, Casey Cardinal, 19 Estacada Road, with plans for a new small accessory structure and new windows. These plans were approved with the following stipulations:
a. Exterior lights shall be downward shielded.

9. UBL # 3-09-01,Edna Nadel, 15 Carlito Road with plans for a portal, garage and connecting wall, and yard wall with a variance request to allow for it . The Committee approved of the portal, garage and connecting wall to the garage as no variances were involved. This approval was made with the stipulation that all exterior lights shall be downward shielded. The request for the variance approval for a ward wall to encroach 10 feet into the 20 foot side setback. This recommendation is being made due to the fact that the committee feels as per reason 4.1; there are site characteristics that make it appropriate location for the structure. This wall variance will be heard by the ECIA Board at their May 20th working meeting.

10. UBL # 3-2-36, Darrell Connelly, 5 Eldorado Circle, with plans for an addition with stucco enclosure wall and 954 Sq. feet of enclosure. These plans were approved with the following stipulations:
a. Exterior lights shall be downward shielded.

 

11. UBL# 1-66-05, Fred McPherson, 9 Quedo Road with plans for a small accessory structure and outdoor fireplace. These plans were approved with the following stipulations:
a. Color of stucco to match homes stucco color.

 

12. UBL#1-66-06, Donna Nincic, 13 Quedo Road with plans for a coyote and stucco pilaster wall/fence. These plans were approved with the following stipulations:
a. Stringers shall be on the inside of the fence.

13. UBL# 2-18-09, Adam Kasper, 34 Alondra Road, with plans for increasing wall height with latillas to a 6 foot height. These plans were approved with the following stipulations;
a. Stringers to be on the inside of the fence.

14. UBL# 2-06-04, Suzanna Van Dyke, 7 Dovela Place, with plans for a new garden wall. These plans were approved with the following stipulations:
a. Color of stucco to match homes stucco color.

15. UBL#, 3-05-12, James Madden, 25 Altura Road, with plans for a Coyote Enclosure fence. These plans were approved with the following stipulations:
a. Resident shall contact the ECIA to verify the distance to the properly line, before work begins.
b. Stringers to be on the inside of the fence

16. UBL#2-12-05, Jessica Bognar, 4 Balde Road, with plans for replacing an existing fence with a new coyote fence at 6 feet tall and with 1864 sq. ft. of enclosure. These plans were approved with the following stipulators:
a. Stringers to be on the inside of the fence

17. UBL# 1-40-04, Ken Curry, 53 Balsa Road, with plans for a 21 x 14 Ramada with metal roof. These plans were approved with the stipulation that the bottom beam of the Ramada shall match the bottom of existing portal.

18. UBL# 30722, Paul Malmquist, 101 Monte Alto Road, with a plans and variance request for replacing an older wood post and wire fence with a new cedar fence that encroaches into the 20 foot setback. In the process they are moving the old fence out of the corner of the utility easement and there will only be encroachment 10 feet into the 20 foot setback. The Committee us recommending approval of this variance request into the setback as this fence is replacing an older one that encroached more, is an improvement to the property and the old fence has been there for more than 10 years. It should also be noted that the closest neighbors at 59 Monte Alto Road were at the meeting and voiced full support for this project due to the lack of privacy between the homes and close proximity to one another. This fence variance will be heard by the ECIA Board at their May 20th working meeting.


Other Business:

1. The Committee discussed the response that the ECIA received from our attorney concerning his legal opinion on whether Accessory Dwelling Structures would be allowable under the Eldorado Covenants, as they became acceptable in the county a few years ago with the new Sustainable Land Development Code. We will be working with the Board to come up with an advisory group to look at this matter and report back to the Board.

Resident is required to contact the ECIA once the project is staked out, but before construction begins, to allow the ECIA to verify the distance to the property lines.

4. UBL# 2-21-45, Ken Krammer , 4 Herrada Court, with plans for a new Home of pueblo adobe revival style. With no compliance issues, these plans were approved with the following stipulations: a. Any exterior lights shall be downward shielded.

 

5. UBL#: 1-22-10, James Wilson, 16 Encantado Road, with plans for a new home of pueblo adobe revival style. With no compliance issues these plans were approved with the following stipulations: a. Any exterior lights shall be downward shielded

6. UBL # 10104, Michael Knarr, 47 Encantado Loop, with plans for a new CMU wall. With no compliance issues these plans were approved with the following stipulations: a. Stucco color of wall to match home.

 

7. UBL# 3-02-07, Kenn Jurgemann, 19 Bosque Loop, with plans for the following projects: 1. Adobe gateway and latillas fence. 2. Portals 3. Adobe Wall. Due to the fact that there was a lack of dimension details for the gateway area, the Committee approved of the project with the stipulation that the resident come back to the ECIA with more detailed dimensions on the adobe gateway. There were also the following stipulations: a. Stucco color of wall to match home. b. The stringers shall be on the inside of the fence.

 

8. UBL#1-55-17, Robin Davidson, 12 Bonito Road, with plans for a wood post and wire fence. . With no compliance issues these plans were approved with no stipulations

 

9. UBL# 1-08-09, Emma Fountain, 37 Camerada Road, with plans for an All wood Ramada that is 8 x 10 x 8 feet tall. With no compliance issues these plans were approved with no stipulations.

10. UBL# 3-24-08, Leonard Stovall, 81 Verano Loop, with plans for a wood poste and wire fence with variance request due to size of over 4000 sq. ft. The Architecture Committee could not recommend approval of this variance request as they feel there are options available to the resident to reduce the enclosure square footage to 4000 square feet so as to not require a variance.

11. UBL # 35335, Gayle Marsh, 27 Cagua Road with plans for 2 rolling shade screens on their home in a dark brown fabric. These plans were approved with no stipulations.

1. Mark Young introduced new Committee Member candidate, Mark Hiatt who was in attendance at the meeting and he told the committee about his background and interest in joining the committee.
2. Mark Young stated that we still do not have an updated on legal opinion concerning Accessory Dwellings

3. The Committee agreed to meet on n 7/22 (Monday) for the 2nd July AC meeting, instead of 7/23 to facilitate vacation schedules for that week.

Due to the fact that the Committee cannot approve of variances, the committee as of the meeting date will be working with the resident to perform a site visit to review the potential impact of such a tall structure and make a recommendation to the ECIA Board. This issue will be heard by the ECIA Board at their April 15th Board Working Session Meeting at 6 PM at the ECIA. 
  1. UBL#:14938, Steve and Peggy Woodward, 82 Herrada Road, with plans for a portal attached to the home. With plans for a new Gazebo.  With no issues of compliance these plans were approved with the following stipulations:    a.  All exterior lighting to be downward shielded

  1. UBL #1-65-21, Julie Christiansen, 18 Recado Road, with plans for a block stucco wall at a height of 4 ft. 5” tall and with a new enclosure of 3377 sq. feet. With two other existing enclosures on the lot the total proposed enclosure will be 3848.75 sq. ft. With no issues of compliance these plans were approved with the following stipulations: 
    1. Stucco color of wall to match homes color.

 

 

  1. UBL# 3-51-13, Russell Thurston, 8 Caliente Place, with plans for a Roof Mount Solar PV system with no visibility over the parapets.  With no issues of compliance these plans were approved with the following stipulations: 
    1. Resident shall call the ECIA at the time of panel installation to verify that the racking system and heights off the roof are as were approved.
  1. UBL# 3-25-12,  Jaclyn McLean, 13 Verano Loop, with plans for adding a new wood post and wire dog fence and  for modification to existing wall to add coyote latillas to the top to a height of 6 feet. With no issues of compliance these plans were approved with the following stipulations: 
  2. a. Resident shall place the fence stringers on the inside of the fence.
    1. Resident shall contact the ECIA, before construction begins on the coyote fence to verify that the setbacks are respected.
  1. UBL#3-48-02, Albert and Donna Weisman, 4 Lauro Place, with plans for a New Garage attached to the home. The design of the garage as well as windows will match the homes style.  With no issues of compliance these plans were approved with the following stipulations: 
    1. Stucco color of wall to match homes color.
    2. Any exterior lighting shall be downward shielded.  
  1. UBL #1-33-03, Vinaya Wall, 2 Vista Grande Circle, with plans to modify an existing Wood post and wire fence, that was built with ECIA approval, and is currently at 7 feet tall.  This existing fence was approved with the stipulation that the fence is brought down to no taller than 6 feet in height and that this is done as soon as possible.

 

 

  1. UBL # 2-19-01, Albert Beradi, 49 Alondra Road with plans for 3200 sq. ft. coyote fence enclosure at a height of 6 feet and with wood gates.   With no issues of compliance these plans were approved with the following stipulations:   
    1. Resident shall place the fence stringers on the inside of the fence.

 

  1. UBL #2-30-06, Wendi McKinnon, 3 Lobo Lane, with plans for a new Dog Eared Fence Enclosure with 1140 sq. feet of new enclosure. The height of the fence was approved up to 5 feet tall. With no issues of compliance these plans were approved with the following stipulations:   
  2. a. Resident shall place the fence stringers on the inside of the fence.

 

Other Business: 

   

  1. Resident Erin Connelly of 3 Hidalgo Court brought a special variance request to the Committee for a shed and fence that was built over 10 years ago, and approved by the ECIA, but which sits in the 20 foot setback and partially in the 10 foot utility easement. This property is under contract with a planned closing on March 19th. While the Committee cannot approve of such variances this issue is being forwarded to the Board, with the Committees recommendation for approval, for review before the March Board meeting, due to the fact that the closing is before the next Board meeting.
  1. Resident Chris Gruber of 19 Aventura Road came to the committee with a shed plan, that had not been placed on the Agenda and the Committee asked that the resident complete the plans and bring them back to the ECIA for review at the March 26th AC meeting.
  1. Staff Liaison, Mark Young, reminded all Committee members that the annual ECIA Volunteer Appreciation party will be April 18th at 5 PM and urged all to RSVP.
