Architecture Committee

The mission of Architecture Committee (AC) is to support the ECIA Board in implementing the Amended and Restated Protective Covenants and Building Restrictions for Eldorado at Santa Fe (Covenants) and Guidelines for Protective Covenants and Building Restrictions for Eldorado at Santa Fe (Guidelines) as residents and developers submit plans for the construction, addition or remodeling of dwellings and other structures covered under the covenants and guidelines.

The AC shall grant approval for projects the AC deems consistent with the Covenants and Guidelines.  The AC shall advise, assist and provide recommendations to the Board based on projects which require and are eligible for a variance to the Covenants and Guidelines which balance the needs of individual residents with the architectural values of the community at large, as described in the Covenants and Guidelines.

All questions, variance requests and documents should be sent to architecturechair@gmail.com. Meetings are held at 3 PM on the 2nd and 4th Tuesday of the month via Zoom. The deadline for submissions to the Architecture Committee is the Wednesday before the meeting at noon. Zoom links can be found under the News & Events tab. Beginning in May 2022, the ECIA Board of Directors has delegated to the Architecture Committee (AC), the responsibility of approving or disapproving variance requests for setback encroachments. This will be a six-month pilot program to see if requests for setback encroachment variances can be streamlined to reduce the workload from the Board. The AC currently makes a recommendation to the Board, who then makes the final decision. The pilot program will ensure that neighbors directly affected by the proposed variance are notified. In addition, there will be an appeal process, should neighbors disagree with a decision made by the Committee. Such appeals will be heard by the Board.

THE PROCESS:

  1. For new Projects, where there is a setback encroachment, Resident shall complete the Architectural Plan Submission Form completely as well as the Setback Variance Request form completely and submit to the ECIA with all the required documents.
  2. Where the variance only involves a setback encroachment, the ECIA Architecture Committee has the authority, as per the ECIA Board, to review the request and make a decision. Where there are multiple variances requests in one plan, this will come first through the Committee for their recommendation but then it will require Board review.
  3. When there is a Setback Variance Request, the applicant shall notify all adjoining neighbors, of the Setback Request, via Certified Mail, at least 14 days in advance of the Architectural Committee Meeting review. This mailing should include a site plan, as well as copies of relevant forms.  (Applicant shall provide copies of the certified mailing receipt (s) to the ECIA.)
  4. The Variance request will be properly warned on the Architectural Committee Agenda, which is posted on the Eldorado Website as well as via email Blast.
  5. Any affected Neighbors of the request are welcome to attend the Architecture Committee meeting either in person or electronically, and make public comments.
  6. Should the Architecture Committee approve of a setback variance, and an affected neighbor is not in agreement with the decision, they may submit a letter of grievance to the ECIA Board, who would act as an appellate to hear the grievance. Such letters of Grievance shall be presented to the ECIA Board within 14 days of the Committees decision, and would be reviewed by the Board at the next Board meeting.    Should the ECIA Board   decide to override the decision of the Committee, they shall provide their justification and findings to both parties.

After the 6-month trial program, the Board will decide whether to make the delegation permanent.
